Ain't it funny how Wingnuts suddenly discover the Constitution when it's time to defend Bush/Cheney's various misdeeds? Apparently, however, they still don't read it.
Congress has the duty to pass legislation of this sort. And after all, someone has to play the part of an adult and manage the Mess in Mesopotamia. Bush and his preadolescent playmates refuse to do it.

Webb's amendment is perfectly within the scope of Congress' power. In fact, the organization of the branches, order of rank and chain of command and Uniform Code of Military Justice all stem from laws passed by Congress(h/t to Josh Marshall).
See, the President doesn't have this power - he's just the Commander-in-Chief. He can't change the way the Armed Forces operate, but Congress can and has done so numerous times throughout our history.
In fact, John, it is the opinion of many, many people that the Founders intentionally enumerated the powers of the Congress before those of the President to suggest that the Legislative branch is the more important of the two.
