Senator, I realize it's early but have you seen this reporting from the New York Times?
The House committee investigating the Jan. 6 attack on the Capitol said on Wednesday that there was enough evidence to conclude that former President Donald J. Trump and some of his allies might have conspired to commit fraud and obstruction by misleading Americans about the outcome of the 2020 election and attempting to overturn the result.
In a court filing in a civil case in California, the committee’s lawyers for the first time laid out their theory of a potential criminal case against the former president. They said they had accumulated evidence demonstrating that Mr. Trump, the conservative lawyer John Eastman and other allies could potentially be charged with criminal violations including obstructing an official proceeding of Congress and conspiracy to defraud the American people.
Again, I realize it's morning and you might not have had a chance to discuss this with your staff but if you were to take a look at that court filing, that would be great.
This is what I want to ask you about:
As the President and his associates propagated dangerous misinformation to the public, Plaintiff was a leader in a related effort to persuade state officials to alter their election results based on these same fraudulent claims.
President Trump, Plaintiff, and several other associates of the President reached out directly to state officials to communicate unsubstantiated allegations of election fraud and request that state legislatures disregard popular election results.18 On January 2, 2021, the President and Plaintiff convened a video conference with hundreds of state legislators from swing states won by candidate Biden.19
That footnote 19 leads to this Breitbart article. It opens thusly:
President Trump spoke to 300 state legislators from the battleground states of Arizona, Michigan, Wisconsin, Pennsylvania, and Georgia on Saturday in a Zoom conference call hosted by Got Freedom? in which the 501 (c) (4) non-profit election integrity watchdog group urged those lawmakers to review evidence that the election process in their states was unlawful and consider decertifying the results of the November 3 presidential election.
President Trump addressed the call for 15 minutes at the invitation of former New York City Mayor Rudy Giuliani, who now serves as the president’s personal attorney, and was one of the featured speakers on the call.
Other featured speakers included Chapman Law School Professor John Eastman, Dr. Peter Navarro, Assistant to the President for Trade and Manufacturing (appearing in his personal capacity), John Lott, Senior Advisor, U.S. Department of Justice (also appearing in his personal capacity), and Liberty University Law School Professor Phill Kline.
Phill Kline was just subpoenaed by the January 6 Committee about this very conference call:
The Select Committee’s investigation has revealed credible evidence that you publicly promoted claims that the 2020 election was stolen and participated in attempts to disrupt or delay the certification of the election results based on your allegations. Between mid-November 2020 and January 6, 2021 (and thereafter), you actively promoted claims of election fraud on behalf of former President Trump.1 As part of that work, you convened a meeting between President Trump and more than 300 state legislatures in attempt to disseminate purported evidence of election fraud, encouraging them to sign onto a letter urging Vice President Mike Pence to delay the electoral certification on January 6, 2021.
You received a subpoena from that committee as well, didn't you?
Yea, how's that going? Will you be publicly addressing it anytime soon?
Anyway, back to that conference call.
Got Freedom, the good folks who hosted the call, issued a press release that included a link to as "evidence" of voter fraud. Ti be sure, I was not able to find it at the link given but luckily the Web Archive has a copy.
On the list of "evidence" is the letter sent out by a number of PA legislators regarding the 2020 election. Pennsylvania was central to the plot, Senator. You know that, right?
So here's my question, Senator:
Were you in on that conference call?
I'm a Pennsylvanian and a voter and I'd like an answer to that question.
You're already entwined, in numerous ways as I've outline here on this blog, in a scheme that is described in that filing as containing possibly "criminal and/or fraudulent acts" committed by Donald Trump.
Given how important Pennsylvania is to Trump's plot, it would be surprising if you weren't in on that conference call.
So, were you? And do you think that when you're called before that committee they'll be asking you about it?
Doesn't that concern you at all?
